Module Learning Objective

define cooperation that preserves responsibilities and independence

1. Regulatory Concept & Core Standards

Today we will learn to define cooperation that preserves responsibilities and independence. Throughout the video, consider the difference between knowing a rule and applying it to a decision. We will work through an example, identify a possible failure and develop a response that can be used at work. Receipt and follow-up require a mandate, impartiality and resources. They may connect with integrity coordination, but the functions are not automatically identical. This course organises decisions, cover arrangements and management information according to the local framework.

The programme involves procurement, finance, human resources, legal, technology and other functions. The integrity coordinator needs information and the ability to challenge, while departments remain responsible for their controls. Management resolves obstacles and provides resources. Follow-up meetings must use appropriate information without turning management reporting into disclosure of individual cases.

Apply the following rule: ANI provides an external platform and information about advice. The internal channel and external reporting to ANI are separate routes. Reasoned requests for documents from ANI must receive a response within 15 working days of receipt under article 17(5); this is not the deadline for informing the reporting person.

2. Practical Implementation & Procedure

Define contacts, required information and internal frequency. For each measure, identify who performs, decides and verifies. Set an escalation route for delays or refusals of information. Distinguish technical disagreement from conflicts of interest. Record decisions and commitments without adding unnecessary personal data to general minutes. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

3. Case Study & Compliance Action

Procurement says supplier review belongs to the integrity coordinator. The coordinator explains that they monitor compliance while procurement performs assessments and preserves evidence. Management confirms the division and allocates implementation resources. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Must the integrity coordinator personally implement every measure in the programme? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

No. The competent department may implement it. The coordinator monitors and verifies within their role. Responsibilities must be explicit so that everyone does not assume someone else will do the work.

One mistake to avoid is: concentrating all implementation on the coordinator while departments have no concrete commitments.

Now apply the national rule to a second decision. The team presents every integrity instrument as mandatory in every country. How should the message be revised?

Distinguish what national law actually requires, the conditions for its application to the entity and the proposed good practices. The specific rule just examined must appear in the corresponding procedure. Each duty needs a source; each management choice needs a purpose, an owner and evidence of implementation.

National Legal Framework: Legea nr. 361/2022, transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
