Module Learning Objective

define cooperation that preserves responsibilities and independence

1. Regulatory Concept & Core Standards

Today we will learn to define cooperation that preserves responsibilities and independence. Throughout the video, consider the difference between knowing a rule and applying it to a decision. We will work through an example, identify a possible failure and develop a response that can be used at work. The compliance officer, known as the RCN, monitors programme implementation and needs effective working conditions. This does not replace operational owners or management. The course organises the role through responsibilities, information, priorities and monitoring evidence.

The programme involves procurement, finance, human resources, legal, technology and other departments. The RCN needs information and the ability to challenge, while departments remain responsible for their controls. Management resolves obstacles and provides resources. Monitoring meetings must use appropriate information without disclosing individual cases through management reports.

National rule: The compliance programme involves management and the departments responsible for implementing its measures. Monitoring by the RCN requires access to the necessary information, resources and the ability to identify shortcomings, while preserving the confidentiality of individual cases.

2. Practical Implementation & Procedure

Define contacts, required information and internal frequency. For each measure, identify who performs, decides and verifies. Set an escalation route for delays or refusals of information. Distinguish technical disagreement from conflicts of interest. Record decisions and commitments without adding unnecessary personal data to general minutes. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

3. Case Study & Compliance Action

Procurement says supplier review belongs to the RCN. The RCN explains that they monitor compliance while procurement performs assessments and keeps evidence. Management confirms the division and allocates resources. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Must the RCN personally implement every measure in the programme? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

No. Implementation may belong to the competent department. The RCN monitors and verifies within the role. Responsibilities must be explicit so that everyone does not assume someone else will do the work.

One mistake to avoid is: concentrating all implementation on the RCN while departments have no concrete commitments.

Which document, responsible person and evidence from your entity demonstrate application of this rule?

Confirm the scope and applicable source. Record the decision, who can approve it and the evidence required. Application in this lesson should support the following objective: define cooperation that preserves responsibilities and independence Distinguish the legal duty from the organisational method chosen by the entity.

National Legal Framework: Lei n.º 93/2021 & RGPC (DL 109-E/2021), transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
