Module Learning Objective

recognise improper influence in business relationships

1. Regulatory Concept & Core Standards

This video's topic is relationships with customers and suppliers. By the end, you should be able to recognise improper influence in business relationships. We will connect the information available, the criterion guiding the decision and the action that must be recorded. Follow the case and compare your answer with the proposed response. The code connects principles with actual decisions. For Maltese public administration, read the First Schedule to Chapter 595 and applicable directives. In private organisations, distinguish entity policy from a specific legal duty.

Professional cooperation requires transparent criteria and consistent treatment. Personal favours and privileged information can affect independence. Gift limits are not identical across countries and entities.

Apply the following rule: Article 6 provides strict identity protection with express written consent; do not substitute a generic exception from another country. Official guidance distinguishes the WRO from the investigative team to avoid compromising identity. This course does not import the Portuguese RGPC. Duties on ethics, risk, training and conflicts depend on sector and the scope of the particular Maltese provision.

2. Practical Implementation & Procedure

Assess the connection between benefit and pending decision. Apply the code and law. Seek independent assessment where personal interests arise. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

Consider how a colleague taking over tomorrow would understand the decision. Identify the verified information and its source, who is authorised to decide and who checks the result. The record should connect the decision to the material actually used rather than repeat the whole file. State critical gaps and assign a specific action to resolve them. This makes continuity independent of one person’s memory. Apply the proposed organisational steps within legal powers. In the case, distinguish observation, conclusion and hypothesis. An observation describes available evidence, a conclusion explains what can reasonably be inferred and a hypothesis still needs checking. Do not infer motives merely from unusual behaviour. Identify which further information could change the decision and whether it can be obtained lawfully and proportionately. Incomplete knowledge justifies neither certainty of guilt nor indifference to an actual risk.

The First Schedule to Chapter 595 sets the Code of Ethics for public employees and board members within its scope. Paragraph 9(d) requires refusal of gifts and benefits, with a narrow exception for token gifts that do not induce or influence duties now or in the future. Paragraphs 10 and 11 address actual or apparent conflicts, disclosure to superiors and resolution. An internal value limit does not make an influential benefit acceptable. Also check applicable directives and the entity’s specific rules.

3. Case Study & Compliance Action

A supplier requests competitors’ prices informally to improve its bid. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Which principles are affected? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

Equal treatment and process confidentiality. Handle the request under applicable rules.

One mistake to avoid is: treating privileged information as ordinary assistance.

Now apply the national rule to a second decision. The team presents all integrity tools as mandatory in every country. How should the message change?

Distinguish the actual national duty and its conditions from recommended practice. The specific rule must appear in the relevant procedure. Every duty needs a source and each management choice needs a purpose, responsible person and implementation evidence. The Portuguese RGPC is not Maltese law.

National Legal Framework: Protection of the Whistleblower Act (Cap. 527), transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
