identify when a situation warrants reporting and which channel to consult
1. Regulatory Concept & Core Standards
In this video we will work through a concrete decision: identify when a situation warrants reporting and which channel to consult. The aim is to explain the criterion used and apply it to a workplace situation. We will start with the concept, move to the procedure and finish with a case to solve. This course takes the perspective of someone who wants to report a concern. The demonstration uses a fictional channel. You do not need legal terminology to describe facts. You need to distinguish what you know, what you suspect and what you cannot confirm. Apply the Hungarian route and protection conditions; the reporting person should honestly distinguish knowledge, suspicion and uncertainty.
Hungarian protection requires a lawful route, work-related information and reasonable grounds to believe it true when reported (section 45). Apart from section 43 assistance, subchapter 8 also requires the section 48 scope: listed EU legal fields, specified EU restrictive measures, or reasonable grounds to believe the matter falls within that scope. Receiving a broader section 20 report does not establish every protection. Personal dislike does not replace these legal tests.
Apply the following rule: Section 20 accepts unlawful or suspected unlawful acts, omissions and other abuses. Eligibility to report differs from entitlement to every safeguard. Section 45 requires the statutory route, information obtained in a work-related context and reasonable grounds to believe it true when reported. Apart from section 43 assistance, subchapter 8 protection also requires the section 48 EU subject matter, specified EU restrictive-measures infringements added in 2025, or reasonable grounds to believe the matter falls within that scope. Apply the section 48(2) exclusions.
2. Practical Implementation & Procedure
Read the channel information and identify the subject. Ask yourself what facts you observed and why they raise concern. Consult the complaints or employment procedure where appropriate. If people face immediate danger, also contact the relevant services. Do not seek unauthorised access to systems to confirm a suspicion. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.
3. Case Study & Compliance Action
A worker reports suspected evasion of EU restrictive measures learned through work, using the designated channel and explaining the documents supporting the concern. The team assesses sections 45 and 48, including the 2025 extension, and safeguards the person while examining the facts. It does not demand a criminal conviction or dismiss the report merely because the worker had a disagreement with management. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.
The exercise is as follows: Must you know every detail and the legal classification before reporting a well-founded suspicion? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.
Check the source of the information, reasonable belief when reporting, the statutory route, the section 48 scope or reasonable belief about that scope, and applicable exclusions. Distinguish the ability to report from entitlement to each safeguard. Preserve confidentiality and document the assessment without a moral test of motive.
One mistake to avoid is: waiting for impossible certainty or filling gaps with assumptions presented as facts.
Now apply the national rule to a second decision. A report is automatically classified as protected because it contains the word corruption. What check is missing?
Read the facts and apply the national scope, context and conditions for protection. A form label helps organise information but does not determine the legal framework. If the case falls outside the regime, identify an appropriate route without unnecessarily disclosing information.
