Module Learning Objective

reduce arbitrary influence in evaluation

1. Regulatory Concept & Core Standards

This video's topic is selection criteria and separation of responsibilities. By the end, you should be able to reduce arbitrary influence in evaluation. We will connect the information available, the criterion guiding the decision and the action that must be recorded. Follow the case and compare your answer with the proposed response. This course examines risks from selection through payment. Public procurement follows national legislation. Recommended controls for private purchasing must not automatically be presented as identical public-procurement requirements.

Clear criteria and appropriate separation support impartiality. Public procurement has specific conflict duties. Measures must also address informal influence.

Apply the following rule: Article 9 generally requires a private-sector reporting officer, ΥΠΠΑ, at 50 workers, with specified financial, transport and environmental activities covered regardless of headcount. Entities with 50–249 workers may share receipt resources under the conditions in the Act. The appointment duty continues for two calendar years after the year in which 50 workers were reached. Article 8 has a separate public-sector allocation, including integrity advisers, supervising ministries and regional officers for smaller municipalities. Do not classify a small public body as entirely outside the reporting framework.

2. Practical Implementation & Procedure

Set criteria before evaluation. Check interest declarations and approval powers. Record reasons for scores and departures with suitable independent review. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

Consider how a colleague taking over tomorrow would understand the decision. Identify the verified information and its source, who is authorised to decide and who checks the result. The record should connect the decision to the material actually used rather than repeat the whole file. State critical gaps and assign a specific action to resolve them. This makes continuity independent of one person’s memory. Apply the proposed organisational steps within legal powers. In the case, distinguish observation, conclusion and hypothesis. An observation describes available evidence, a conclusion explains what can reasonably be inferred and a hypothesis still needs checking. Do not infer motives merely from unusual behaviour. Identify which further information could change the decision and whether it can be obtained lawfully and proportionately. Incomplete knowledge justifies neither certainty of guilt nor indifference to an actual risk.

For Greek public contracts, Law 4412/2016 article 24 provides for prevention, identification and remedy of conflicts of interest. Disclosure enables the contracting authority to decide appropriate corrective measures. Check the specific role and applicable regime. A private-purchasing policy must not automatically be described as the same public procedure.

3. Case Study & Compliance Action

An evaluator changes weights after seeing bids so that a particular supplier ranks first. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Why does this require examination? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

Retrospective changes may undermine equal treatment and the prescribed process. Assess facts and applicable rules.

One mistake to avoid is: changing criteria to obtain a desired result.

Now apply the national rule to a second decision. A subsidiary copies its foreign parent’s policy without assessing its activities and size. What must it check?

Identify the local legal entity, sector, national workforce-counting method and specific public or local provisions. Connect each duty to a source and responsible person. The group model does not replace this assessment.

National Legal Framework: Law 4990/2022 (Whistleblower Protection), transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
