identify the duties of the particular entity
1. Regulatory Concept & Core Standards
Today we will learn to identify the duties of the particular entity. Throughout the video, consider the difference between knowing a rule and applying it to a decision. We will work through an example, identify a possible failure and develop a response that can be used at work. An integrity programme connects risks, conduct rules, controls and reports. The Portuguese RGPC does not apply as national law in Greece or Cyprus. Each duty is assessed for the particular entity.
Legal form, sector and workforce affect the internal-channel duty. National exceptions and public-sector rules apply. A threshold of fifty workers does not resolve every case.
Apply the following rule: Article 9 generally requires a private-sector reporting officer, ΥΠΠΑ, at 50 workers, with specified financial, transport and environmental activities covered regardless of headcount. Entities with 50–249 workers may share receipt resources under the conditions in the Act. The appointment duty continues for two calendar years after the year in which 50 workers were reached. Article 8 has a separate public-sector allocation, including integrity advisers, supervising ministries and regional officers for smaller municipalities. Do not classify a small public body as entirely outside the reporting framework.
2. Practical Implementation & Procedure
Record country, legal entity, activities and workforce calculation. Check the special provisions in the national overview. Link each conclusion to a current source. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.
Consider how a colleague taking over tomorrow would understand the decision. Identify the verified information and its source, who is authorised to decide and who checks the result. The record should connect the decision to the material actually used rather than repeat the whole file. State critical gaps and assign a specific action to resolve them. This makes continuity independent of one person’s memory. Apply the proposed organisational steps within legal powers. In the case, distinguish observation, conclusion and hypothesis. An observation describes available evidence, a conclusion explains what can reasonably be inferred and a hypothesis still needs checking. Do not infer motives merely from unusual behaviour. Identify which further information could change the decision and whether it can be obtained lawfully and proportionately. Incomplete knowledge justifies neither certainty of guilt nor indifference to an actual risk.
In the Greek public sector, the framework of Law 4795/2021 applies as supplemented by Law 5013/2023. EAD has issued a risk-management policy and framework model for adaptation by public bodies within scope. Check applicability and the current national procedure. The training example does not replace the required public framework or automatically extend it to every private company.
3. Case Study & Compliance Action
A company has eighty workers, a financial business thirty and a municipality twenty. The same numerical answer cannot resolve all three cases. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.
The exercise is as follows: Is every entity below fifty workers exempt? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.
No. Check the country’s sectoral and public-sector provisions. Do not copy another state’s exemption.
One mistake to avoid is: using headcount as the only criterion.
Now apply the national rule to a second decision. A subsidiary copies its foreign parent’s policy without assessing its activities and size. What must it check?
Identify the local legal entity, sector, national workforce-counting method and specific public or local provisions. Connect each duty to a source and responsible person. The group model does not replace this assessment.
