Module Learning Objective

apply conflict assessment to different situations

1. Regulatory Concept & Core Standards

In this video we will consolidate a skill: apply conflict assessment to different situations. Use the case to test what you would do in a similar situation. We will explain the proposed response step by step so that you can understand each choice and recognise when more information would be needed. A conflict can exist without actual corruption. Distinguish KVS public-function requirements from private organisational policy. This course accounts for the 19 July 2026 changes to connected persons and restrictions. It assumes no universal statutory euro limit for gifts.

Identical principles can lead to different outcomes depending on role and rule. Kinship, ownership and other strong influence need precise assessment. The 2026 KVS text also includes specified beneficial-ownership connections. Every acquaintance is not automatically the same statutory category.

Apply the following rule: Section 4(4) permits direct external reporting. Under section 6, competence follows the relevant statutory supervisory or offence-procedure powers. No authority handles every subject. Public disclosure requires the separate section 12 conditions. Using a technology provider does not turn an employer channel into an official external channel.

2. Practical Implementation & Procedure

Assess relationship, power and applicable rule in each example. Identify missing facts and independent checks. Describe lawful recusal or other proportionate measures without collecting excessive family data. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

3. Case Study & Compliance Action

Cases involve evaluating a relative’s business, receiving a supplier invitation and deciding an advantage for a connected business. Each response is separately justified. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Can all personal relationships be treated as one automatic legal prohibition? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

Not accurately. Check statutory categories and facts. A stricter internal policy may exist, but must be labelled as such.

One mistake to avoid is: treating different connections alike without checking the rule.

Now apply the national rule to a second decision. An advice page is listed as the only recipient for every report. What needs verification?

Check the recipient’s powers over the particular breach and official reporting method. Advice, intake and investigation may differ. Section 4(4) permits external reporting without prior internal reporting. Public-disclosure conditions remain separate.
