Module Learning Objective

choose proportionate measures for different conflicts and benefits

1. Regulatory Concept & Core Standards

In this video we will consolidate a skill: choose proportionate measures for different conflicts and benefits. Use the case to test what you would do in a similar situation. We will explain the proposed response step by step so that you can understand each choice and recognise when more information would be needed. Rules vary by role, sector and entity. This course sets no universal acceptable gift value. It develops assessment criteria and declaration, review and decision procedures to align with the code of conduct and applicable special regimes.

Family and business links may be relevant, but consequences depend on role, interest and applicable rules. Automatically excluding every related company is not a universal solution. Public procurement requires appropriate prevention and handling of conflicts under section 4 of the Public Procurement Act within its scope. Private organisations also need to assess their relevant duties and controls.

Apply the following rule: Den Nationale Whistleblowerordning, administered by Datatilsynet, is the general external scheme. Special external schemes also exist. A person may report externally directly without a general requirement to report to the employer first. Protection for public disclosure requires a separate assessment under section 5(2).

2. Practical Implementation & Procedure

Identify the relationship and influence over the decision. Assess possible measures and the competent decision-maker. Apply relevant criteria and document reasons. In public procurement, exclusion and remedial questions must follow procurement rules. Respect the relevant rights of the supplier and individuals concerned. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

3. Case Study & Compliance Action

A director helps define recruitment requirements and only then reveals that a relative will apply. Assessment must consider preparatory acts and possible independent review of the profile. Absence from the final interview may not remove earlier influence. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Why must conflict management cover preparation of the decision? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

Criteria, requirements and information can determine the result before final approval. Measures must address stages where influence exists, including review of earlier work where necessary.

One mistake to avoid is: limiting conflict management to the final vote or signature.

Now apply the national rule to a second decision. An advice page is presented as the sole destination for every report. What check is missing?

The recipient's powers and role must be confirmed. Advice, external receipt, investigation and protection may belong to different bodies. Also check the national conditions for the selected route. User information must help people find the correct procedure without requiring steps that do not exist in law.

National Legal Framework: Lov om beskyttelse af whistleblowere, transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
