Module Learning Objective

identify initial allegations and intake tasks

1. Regulatory Concept & Core Standards

In this video we will work through a concrete decision: identify initial allegations and intake tasks. The aim is to explain the criterion used and apply it to a workplace situation. We will start with the concept, move to the procedure and finish with a case to solve. The private company Horizonte Equipamentos, its 120 employees and all events are fictional. Five episodes follow suspected improper benefit in purchasing. An internal procedural failure is not automatically a crime or a public procurement. Scope and competence are checked throughout.

Horizonte Equipamentos is purchasing machinery. An identified employee alleges changed criteria after bids, a supplier linked to the director and mention of a personal benefit intended to influence selection. Two spreadsheet versions are attached. These are allegations and verifiable material. The possible publicly prosecuted offence is assessed under Bulgarian scope; a private purchase is not automatically public procurement.

Apply the following rule: Article 3 covers listed EU matters and national extensions, including employment legislation, public service, public receivables and public-prosecution offences learned of through work. Check article 4 exclusions. Protection under articles 5–7 requires the relevant context, reasonable grounds concerning truth and scope at the time of reporting, and the statutory route. The May 2025 amendment removed the former general exclusion for breaches more than two years old.

2. Practical Implementation & Procedure

The handler records receipt and preserves attachments. She checks formal requirements, scope and secure contact, acknowledges within seven days and tracks the separate feedback deadline. Registration and access follow the applicable rules. Where indications of a committed offence exist, the teaching sequence must not delay mandatory referral. Before moving on, turn this procedure into a sequence you could explain to a colleague. Identify the first check, the action that depends on its outcome and the record that allows the decision to be reconstructed. Follow the sequence on screen and identify the point where an error would change the result.

3. Case Study & Compliance Action

One version has a new criterion but may be an unused simulation. Mention of a personal benefit was overheard without full context. The team records those limits and assesses the competent procedure. Now read the case carefully. Separate established facts from information you would still need to confirm. Do not add motives or events that have not been described. This distinction matters when choosing a response proportionate to the information available.

The exercise is as follows: Can intake establish that bribery is proven? Choose an answer and write one sentence explaining it. During the pause, compare your choice with the criteria we have just considered. Also think about the material you would retain to explain the decision later.

No. Allegations and materials were received and their meaning needs assessment. Scope differs from final guilt. Referral when indications of an offence exist does not require an internal conviction.

One mistake to avoid is: turning an initial allegation into a final accusation.

Now apply the national rule to a second decision. A report is automatically classified as protected because it contains the word corruption. What check is missing?

Read the facts and apply the national scope, context and conditions for protection. A form label helps organise information but does not determine the legal framework. If the case falls outside the regime, identify an appropriate route without unnecessarily disclosing information.

National Legal Framework: ZZLPSPOIN (Whistleblower Protection Act), transposing Directive (EU) 2019/1937 of the European Parliament and of the Council on the protection of persons who report breaches of Union law.
