The general 50-worker rule

Portuguese Law 93/2021 provides for internal channels in legal entities, including private and public bodies, employing 50 or more workers. Headcount, entity structure and the specific framework should be confirmed before implementation.

Sectors where size may not be the only criterion

The law includes rules for entities covered by certain European Union acts, including regulated areas. In those cases, the obligation may arise from the sector and not only from workforce size.

Do not decide from one question alone

Legal nature, workforce, activity, location and sector legislation should be assessed together.

Public entities

The public sector is covered by the applicable provisions. Municipalities, services, institutes and other entities should confirm their position considering legal form, workforce and specific regime.

Corporate groups and centralised channels

According to MENAC guidance, a channel operated by a foreign parent company does not automatically remove the obligation for an entity or branch in Portugal to comply with the Portuguese regime. A centralised solution must be assessed against local requirements.

  • Confirm the workforce and applicable counting method.
  • Check whether the activity is subject to sector rules.
  • Assess group entities, branches and channels separately.
  • Document the conclusion and obtain legal advice where needed.
